RESOLVED THAT:

 

Councillor A C Saffell take the chair for the remainder of the meeting.

Apologies for Absence

Minutes:

There were no apologies for absence received.

 

 

3.

Declaration of Interests

Under the Code of Conduct members are reminded that in declaring interests you should make clear the nature of that interest and whether it is a disclosable pecuniary interest, registerable interest or other interest.

 

Minutes:

No interests were declared.

 

 

4.

Exclusion of Press and Public

The officers consider that the press and public should be excluded during consideration of the following items in accordance with Section 100(a) of the Local Government Act 1972 as publicity would be likely to result in disclosure of exempt or confidential information.  Members are reminded that they must have regard to the public interest test and must consider, for each item, whether the public interest in maintaining the exemption from disclosure outweighs the public interest in making the item available.

Minutes:

RESOLVED THAT:

 

“In accordance with regulation 14 of the Licensing Act 2003 (Hearings) Regulations 2005 the Sub-Committee determined that the public should be exclude form the hearing as the public interest in excluding the public outweighed the public interest in the hearing taking place in public.”

 

 

 

 

5.

Consideration of a Personal Licence

To determine a personal licence.

 

A Notice of Hearing inviting the licence holder to attend has been sent. If they fail to attend, the hearing can be held in their absence or adjourned.

 

The following documents are attached:

 

a)    Report of the Licensing Enforcement Officer.

 

At the beginning of the Hearing, the authority shall explain to the parties the procedure it is proposed to follow. The Hearing shall take the form of a discussion led by the authority and cross-examination shall not be permitted unless it is required to consider the representations.

Minutes:

The sub-committee considered the report of the Licensing Enforcement Officer and had the opportunity to ask questions of the officer.

 

The sub-committee adjourned the meeting at 10.55am and reconvened at 11.45am.

 

The Legal Advisor read out the decision of the sub-committee, stating that the licence was to be revoked.
