Decision:
Section 4 of the Scrap Metal Dealers Act 2013
allows the licensing authority to revoke a licence on the grounds
that:
(i)the licensee is not carrying on business at any of the sites
identified in the licence.
(ii)the site manager named in the licence is not acting as a site
manager at any of the sites identified in the licence.
In accordance with paragraph 11 of section G1 of Section G –
Officer Scheme of Delegation within the Council’s
constitution, I therefore, authorise that the scrap metal licence
with reference 23/00548/SCRAP to be revoked.
The licensee is not carrying out any business at any of the sites
identified in the licence and the site manager named in the licence
is not acting as site manager at any of the site identified in the
licence.
Reasons for the decision:
1.the licensee is not carrying on a business
at any of the sites identified in the licence.
2.the site manager named in the licence is not acting as a site
manager at any of the sites identified in the licence.
Alternative options considered:
(ii)Take no action in respect to the licensee
not carrying out any business at any of the sites identified in the
licence.
(iii)Take no action in respect to the site manager named in the
licence not acting as a site manager at any of the sites identified
in the licence
By revoking the licence, it will make it easier to identify any
breaches if the business starts operating on site in the
future.
