Decision:

To grant the street trading consent renewal for Ryan's
Baked Potato's, O/S 32 Market Street, Ashby De La
Zouch following an Officer panel hearing.

Reasons for the decision:

In reaching its decision the officer panel has had regard
to the evidence and representations of the applicant and
the Town Council together with the Council’s Street
Trading Policy.

Further the panel acknowledged that although the
representations made by the Town Council show a
legitimate concern, the representations were speculative
and not supported by any relevant evidence from the
public or local business.

Having considered all these factors the panel has decided
to Grant the application. The panel did not consider that
the representations and evidence received from the Town
Council could justify the refusal of the application on the
grounds that the grant of the application would
undermine the promotion of the street trading policy
objectives.

Therefore, the street trading consent is granted subject
to the mandatory conditions, and additional added
conditions.

options available are to:
(i) Grant the Street Trading Consent with conditions
attached
(ii) Refuse the application and a proportion of the fee
refunded as appropriate to the applicant.
