Agree to 'make' the Hugglescote and Donington
le Heath Neighbourhood Plan
Reasons for the decision:
In a referendum in the parish of Hugglescote
and Donington le Heath on 21 October 2021 91.9% of those who voted
supported the proposal that the Neighbourhood Plan be used to help
determine planning applications within the parish.
The Hugglescote and Donington le Heath Neighbourhood Plan meets the
Basic Conditions and its preparation process has been compliant
with legal and procedural requirements. Paragraph 38A(4)(a) of the
Planning and Compulsory Purchase Act 2004 requires the Council to
make the Neighbourhood Plan if more than half of those voting in
the referendum have voted in favour of the Plan being used to help
decide planning applications in the area.
Alternative options considered:
The council has to decide whether to 'make'
the plan following the Referendum on 21 October 2021. Such a
decision has to be made within 8 weeks of the referendum.
The plan has been subject to Examination, and has been found to be
acceptable , subject to some modifications, and was overwhelmingly
supported at the referendum so not proceeding to 'make' the plan
was considered to be inappropriate.
