Declaration of interests - members are reminded that following the adoption by Council of the new Code of Conduct, any declaration of interest should be made having regard to the new code. In particular, members must make clear the nature of the interest and whether it is 'personal' or 'prejudicial'.

The Monitoring Officer would like to remind members that when they are considering whether the following items are exempt information under the relevant paragraph under part 1 of Schedule 12A of the Local Government Act 1972 they must have regard to the public interest test. This means that members must consider, for each item, whether the public interest in maintaining the exemption from disclosure outweighs the public interest in making the item available to the public.
1 ELECTION OF CHAIRMAN
RESOLVED THAT:

Councillor P Holland take the Chair for the meeting.
2 APOLOGIES FOR ABSENCE
There were no apologies for absence received.
 
3 DECLARATION OF INTERESTS
There were no interests declared.
 
4 EXCLUSION OF PRESS AND PUBLIC
RESOLVED THAT:

In pursuance of Section 100A (4) of the Local Government Act, 1972, the press and public be excluded from the meeting for the following business on the grounds that it involved the likely disclosure of exempt information as defined in paragraph 7 of Part 1 of Schedule 12A to the Act, and in the circumstances of the matter under consideration, the public interest in maintaining the exemption outweighed the public interest in disclosing the information.
The officers consider that the press and public should be excluded during consideration of the following items in accordance with Section 100(a) of the Local Government Act 1972 as publicity would be likely to result in disclosure of exempt or confidential information.
5 APPLICATION FOR A HACKNEY CARRIAGE DRIVER'S LICENCE
The Licensing Enforcment Officer presented the report and highlighted the options available to members.

There were no questions to the Licensing Enforcement Officer.

The applicant put forward his case. He stated that the incident that had lead to the caution being received and not informing the authority of this had both been big mistakes. He also stated that he had learnt a huge lesson and that he would never make either mistake again.

The Applicant's former employer put forward a supporting case to the committee stating that at the time of the incident there had been a lot of stress and tension within the applicant's personal life and this had now been sorted out and put behind him. He also stated that during his employment with his firm, the applicant had an exceptional work record and was often requested by regular customers. He also informed the committee that he was aware that the applicant had applied to another authority for a licence which had been granted.

Following a questions from the Licensing Enforcement Officer and members the applicant stated that he had declared everything on his application form to the other authority in July 2010, but had received assistance in completing these forms.

In response to questions from members the applicant stated that he had completed the forms on his own and that there had been a misunderstanding as to what information he needed to declare on them.

Follwing a question from the Legal Advisor, the Licensing Enforcement Officer confirmed that the applicant had passed all parts of the knowledge test.

The Licensing Enforcement Officer did not wish to give a closing statement.

The applicant gave a brief closing statement relitarating that it had all been a big mistake that he regretted deeply.

The Legal Advisor provided the committee with advice on the options that were before them and issues that were to be considered when reaching its decision.

At 7.10pm the Sub Committee adjourned to consider its decision. The meeting reconvened at 7.27pm.

RESOLVED THAT:

The application for a hackney carriage driver's licence be granted with a strict warning issued that the holder must notify the authority of any change to informtion that relates to the licence. Failiure to disclose would mean revocation of the licence with immediate effect.
