Declaration of interests - members are reminded that following the adoption by Council of the new Code of Conduct, any declaration of interest should be made having regard to the new code. In particular, members must make clear the nature of the interest and whether it is 'personal' or 'prejudicial'.

The Monitoring Officer would like to remind members that when they are considering whether the following items are exempt information under the relevant paragraph under part 1 of Schedule 12A of the Local Government Act 1972 they must have regard to the public interest test. This means that members must consider, for each item, whether the public interest in maintaining the exemption from disclosure outweighs the public interest in making the item available to the public.

2 APOLOGIES FOR ABSENCE
There were no apologies for absence received.
 
3 DECLARATIONS OF INTEREST
There were no interests declared.
 
4 EXCLUSION OF PRESS AND PUBLIC
RESOLVED THAT:

In pursuance of Section 100A (4) of the Local Government Act, 1972, the press and public be excluded from the meeting for the following business on the grounds that it involved the likely disclosure of exempt information as defined in paragraph 7 of Part 1 of Schedule 12A to the Act, and in the circumstances of the matter under consideration, the public interest in maintaining the exemption outweighed the public interest in disclosing the information.
The officers consider that the press and public should be excluded during consideration of the following items in accordance with Section 100(a) of the Local Government Act 1972 as publicity would be likely to result in disclosure of exempt or confidential information.
5 CONSIDERATION OF A HACKNEY CARRIAGE DRIVER'S LICENCE
The Licensing Enforcement Officer presented the report which asked members to determine whether the licence holder was still a fit a proper person to hold a licence.

In response to a question from the Licence holder, the Licensing Enforcement Officer advised that there was no representation regarding the complaint in question as there was nothing on file.

There were no questions from members for the Licensing Enforcement Officer.

The licence holder presented his case. He stated that he was sorry for what had happened. He explained that in respect of the complaint from a member of the public, it was not possible to exceed the speed limit on the road in question, and in respect of the speeding offence, he was unfamiliar with the road and had missed the sign indicating a 40 mph speed limit, and had believed the speed limit to be 70 mph. He added that the speedometer on his motorcycle was inaccurate, and he had committed no other speeding offences while he had been driving his taxi. He referred to the character references in the additional information he had submitted prior to the meeting. He added that he had undertaken a GNVQ as asked and booked the DSA driving test.

In response to questions from the Licensing Enforcement Officer, the Licence Holder stated the following:

- His DSA test was booked on 30 April in Loughborough.

- His speedometer was not calibrated and therefore there would be a margin of error.

- He hadn't driven his motorcycle since the speeding offence and intended to sell it as he did not want to take the risk of having similar issues in future.

- He had not changed his driving style in his car since the speeding offence as he had never knowingly driven over the speed limit.

In response to questions from members, the Licence Holder stated the following:

- He had missed the 40 mph speed limit sign as he had recently passed his motorcycle test and did not have much experience of riding motorcycles. He added that he was taking more notice of other cars.

- He genuinely believed that the speed limit was 70 mph, and the motorcycle he was riding was 14 years old.

- He stated that the people who had provided character references were aware that he had been disqualified from driving.

- The court had not given any reasons as to their decision to disqualify him from driving.

- He had taken advice from his solicitor and had decided not to appeal the decision due to the fact that the disqualification period was 14 days, and the time it would take for the appeal to be heard.

Both the Licensing Enforcement Officer and the Licence Holder gave brief closing remarks reiterating points raised earlier in the meeting.

The Sub Committee adjourned for consideration at 7.04pm and reconvened at 7.30pm.

RESOLVED THAT:

The meeting be adjourned pending the outcome of the DSA driving test on 30 April 2010.

The meeting was adjourned at 7.31pm.

The meeting was reconvened at 6.30pm on Wednesday, 30 June 2010.

The licence holder was in attendance and was supported by his employer.


The Licensing Enforcement Officer gave an overview of the report and summarised the points discussed on 31 March 2010. He advised members that the licence holder has passed the DSA driving test on 30 April 2010.

There were no questions for the Licensing Enforcement Officer.

In response to questions from a member, the licence holder stated that he had not sold his motorcycle, however he was not using it and it was off the road. He also stated that there were no further convictions pending.

The Licence Holder gave brief closing remarks reiterating points raised earlier in the meeting.

The Sub Committee adjourned for consideration at 6.36pm and reconvened at 6.51pm.

RESOLVED THAT:

The private hire driver's licence be permitted to continue to its expiry date of 30 June 2010.
