Declaration of interests - members are reminded that following the adoption by Council of the new Code of Conduct, any declaration of interest should be made having regard to the new code. In particular, members must make clear the nature of the interest and whether it is 'personal' or 'prejudicial'.

The Monitoring Officer would like to remind members that when they are considering whether the following items are exempt information under the relevant paragraph under part 1 of Schedule 12A of the Local Government Act 1972 they must have regard to the public interest test. This means that members must consider, for each item, whether the public interest in maintaining the exemption from disclosure outweighs the public interest in making the item available to the public.
1 ELECTION OF CHAIRMAN
RESOLVED THAT:

Councillor N Smith take the Chair for the meeting.
2 APOLOGIES FOR ABSENCE
There were no apologies for absence.
 
3 DECLARATION OF INTERESTS
There were no declarations of interest.
 
4 EXCLUSION OF PRESS AND PUBLIC
RESOLVED THAT:

The press and public be excluded from the meeting for the following business on the grounds that it would disclose confidential or exempt information under the provisions of regulation 14 of the Licensing Act 2003 (Hearings) Regulations 2005/44
The officers consider that the press and public should be excluded during consideration of the following items in accordance with Section 100(a) of the Local Government Act 1972 as publicity would be likely to result in disclosure of exempt or confidential information.
5 AN APPLICATION FOR A PERSONAL LICENCE IN RESPECT OF: SIMON CHRISTOPHER DEACON
The Chairman introduced the parties and explained the procedure to be followed. The Hearing Regulations 2005 stated that the Authority must allow parties an equal period of time in which to present their evidence. It was agreed that the maximum time for each presentation be ten minutes.

The Legal Advisor informed all parties that the applicant had presented a further two letters of support. All parties agreed to allow them to be considered.

The Licensing Enforcement Officer presented the report and highlighted background information and representations received.

There were no questions for the Licensing Enforcement Officer.

Sergeant S Moore proposed that he present his representation before the applicant, to give the applicant an opportunity to respond to any comments during his presentation. The Members and the applicant agreed.

Sergeant S Moore presented the representation on behalf of the Leicestershire Constabulary as detailed within the agenda. He gave members more detailed accounts of the circumstances leading to the convictions. He also asked the committee to consider the difference between the guidance and the act itself when considering the application.

The applicant addressed the committee. He explained his on versions of the events and circumstances surrounding his convictions. He highlighted the letters of support that had been written and informed the committee that since manageing the pub, it had gone from strenght to strenght and was now used for various events by the whole community.

The current Designated Premises Supervisior addressed the committee. She informed the members that she had worked in the licensed trade for 25 years. She highlighted to the committee that the area had become safer and that the applicant had made a great impact on the pub and the village as a whole.

Following questions from Members the applicant provided further clarity on his current personal situation, that he had the tenancy of the pub for 5 years and if unsuccessful would apply again once the current time had elapsed.

Both parties gave a brief closing statement.

At 7.29pm the Sub Committee adjourned to consider its decision and re-convened at 8.02pm.

The Chairman of the Committee informed the applicant of the committee's decision.
