Declaration of interests - members are reminded that following the adoption by Council of the new Code of Conduct, any declaration of interest should be made having regard to the new code. In particular, members must make clear the nature of the interest and whether it is 'personal' or 'prejudicial'.

The Monitoring Officer would like to remind members that when they are considering whether the following items are exempt information under the relevant paragraph under part 1 of Schedule 12A of the Local Government Act 1972 they must have regard to the public interest test. This means that members must consider, for each item, whether the public interest in maintaining the exemption from disclosure outweighs the public interest in making the item available to the public.
1 ELECTION OF CHAIRMAN
RESOLVED THAT:

Councillor N Smith take the chair for the remainder of the meeting.
2 APOLOGIES FOR ABSENCE
There were no apologies for absence.
 
3 DECLARATIONS OF INTEREST
There were no interests declared.
 
4 AN APPLICATION FOR THE GRANT OF A PREMISES LICENCE IN RESPECT OF DISEWORTH VILLAGE HALL, HALLGATE, DISEWORTH, DERBYSHIRE, DE74 2QJ
The Chairman introduced the parties and explained the procedure to be followed. The Hearing Regulations 2005 stated that the Authority must allow parties an equal period of time in which to present their evidence. It was agreed that the maximum time for each presentation be ten minutes.

The Licensing Enforcement Officer presented the report, highlighted background information and representations received.

There were no questions for the Licensing Enforcement Officer.

Mr Hurley then presented the application as detailed in the report. He gave some background information regarding the history of the hall and the kinds of events that were held there. Mr Hurley expressed concerns regarding policing the proposed condition as requested by the Environmental Protection section, since members of the Committee were not always in attendance at events. Mr Hurley stated that, had the licence not lapsed, events would have continued to be held at the hall without any restrictions, and he added that Temporary Event Notices had been granted in the past with no restrictions. Mr Hurley stated that there had been no objections from neighbours and suggested that the proposed condition could be included as a recommendation in the terms of booking for future events at the hall.

In response to questions from members, Mr Hurley stated that following:

- The hall had been used for events since being built in 1946.

- The nearest property was approximately 15 feet away.

- No committee members were present during events, the hall was the responsibility of the persons who had booked the hall.

- Events would continue until 11 or 12 in the evening. No alcohol was sold at the hall.

- There had never been any complaints received from neighbours in respect of noise nuisance.

In response to a question, Mr Hurley stated that the previous licence had lapsed due to a misinterpretation of the changes to the legislation in 2005.

The Committee the Sub Committee adjourned to consider its decision at 2.47pm and re-convened at 3.15pm.

RESOLVED THAT:

The licence be granted as applied for with the addition of the condition requested by the Environmental Protection Section as amended by the panel to read:

Doors and windows to be kept closed after 11pm during regulated entertainment events except for access and egress.
