Declaration of interests - members are reminded that following the adoption by Council of the new Code of Conduct, any declaration of interest should be made having regard to the new code. In particular, members must make clear the nature of the interest and whether it is 'personal' or 'prejudicial'.

The Monitoring Officer would like to remind members that when they are considering whether the following items are exempt information under the relevant paragraph under part 1 of Schedule 12A of the Local Government Act 1972 they must have regard to the public interest test. This means that members must consider, for each item, whether the public interest in maintaining the exemption from disclosure outweighs the public interest in making the item available to the public.
4 AN APPLICATION FOR THE VARIATION OF A PREMISES LICENCE IN RESPECT OF: ASHBY WAR MEMORIAL CLUB, NORTH STREET, ASHBY DE LA ZOUCH, LEICESTERSHIRE, LE65 1HS
The meeting had been previously adjourned at 4.36pm on 8 October 2009 and had now been re-convened at 3.00pm on 15 October 2009.

The Legal Advisor explained that the Members had been to visit the premises earlier in the day.

All parties gave a brief closing speech re-iterating the issues raised during their representations.

As part of the applicant's representative's closing speech, he offered the following conditions for Members to consider:

- The first floor terraced area to be closed at midnight on Friday and Saturday night.

- Patrons to leave the premises using the Market Street exit, this was from the request of the Police.

- The withdrawal of the request for the additional hour for the function room. This would remain at 12 midnight.

- The installation of an internal acoustic lobby for all external doors.

- After further discussions regarding the surface of the decking as it became very slippery during rain, the applicant proposed the installation of a non-slip surface on all decking areas outside of the premises.

At 3.50pm the Sub Committee adjourned to consider its decision and re-convened at 4.36pm.

RESOLVED THAT:

The application be granted as amended by the applicant and with the conditions detailed below, with the addition of the condition proposed by the Leicestershire Constabulary regarding the installation of CCTV; the precise wording to be delegated to the Director of Environment.

Amendments and/or conditions to the Licence:

1. No bottles or glasses permitted onto Market Street, North Street or any other public place.

2. The Premises Licence Holder will comply with the Dispersal Policy.

3. The total capacity figure for the premises was 450, comprising 200 for the Function Room, 100 for the Family Room and 150 for the Billiard Room on the first floor.

4. Noise from the premises as measured at the nearest residential property shall be no more than 5dBA greater than the existing background level.

5. During regulated entertainment, all doors shall remain closed except for access and egress and all windows shall remain closed except in the case of emergencies.

6. Suitable sound attenuation measures shall be maintained in accordance with the premises Licence Holder's noise risk assessment and in consultation with the Environmental Health Department.

7. "Acoustic lobbies" would be installed internally to all outside doors.

8. During regulated entertainment regular noise patrols will be conducted by staff to ensure acceptable levels are not exceeded.

9. A noise limiter shall be installed in conjunctions with the recommendations from the Environmental Health Department.

10. Customers using the Family Room and/or Billiard Room will enter and exit the premises solely from market Street except in the case of emergencies.

11. The first floor outside terraced area would be cleared of patrons at midnight.

12. The Function Room was currently licensed for live and recorded music and performance of dance, late night refreshment and the supply of alcohol until 1.00am on a Friday and Saturday evening and the application had been to extend this until 2.00am. The application was varied so that there would be a cessation of all licensable activities at 12.00 midnight on a Friday and Saturday night (the existing additional hours on New Year's Eve and the seasonal variations would still apply).

13. The Applicant would install suitable non-slip surfaces on all outside wooden decked areas.
