Declaration of interests - members are reminded that following the adoption by Council of the new Code of Conduct, any declaration of interest should be made having regard to the new code. In particular, members must make clear the nature of the interest and whether it is 'personal' or 'prejudicial'.

The Monitoring Officer would like to remind members that when they are considering whether the following items are exempt information under the relevant paragraph under part 1 of Schedule 12A of the Local Government Act 1972 they must have regard to the public interest test. This means that members must consider, for each item, whether the public interest in maintaining the exemption from disclosure outweighs the public interest in making the item available to the public.
1 ELECTION OF CHAIRMAN
RESOLVED THAT:

Councillor N Smith take the Chair for the remainder of the meeting.
2 APOLOGIES FOR ABSENCE
There were no apologies for absence.
 
3 DECLARATIONS OF INTEREST
There were no declarations of interest.
 
4 AN APPLICATION FOR A REVIEW OF A PREMISES LICENCE IN RESPECT OF: MERCURY NEWS, 4 SILVER STREET, WHITWICK, COALVILLE, LEICESTERSHIRE, LE67 5ET
The Chairman introduced the parties.

Police Constable Phillips presented the application for review as detailed within the report including the proposed conditions requested to be imposed.

Mr S Meek then presented his case and made the following statements:

- CCTV had already been installed and checked by the Leicestershire Constabulary Crime Reduction Officer.

- The Designated Premises Supervisor had recently passed a recognised qualification for Designated Premises Supervisor's as requested by the Leicestershire Constabulary.

- The Challenge 21 Policy was already in place when the test purchases were conducted but further training has been undertaken for all members of staff at the shop.

- Identification labels had been ordered to be placed on all alcohol items but had not yet arrived.

Mr S Meek, as part of his closing speech stated that the company took the issue of underage sales very seriously and refresher training would be carried out in October at all branches.

The applicant declined the opportunity to give a closing speech.

At 10.15am the Sub Committee adjourned to consider its decision and re-convened at 10.30pm.

The Legal Advisor read out the Members decision, findings of fact and the reasons for the decision.
RESOLVED THAT:

The following conditions be imposed onto the premise licence:

(a) The Licensee will ensure that CCTV is installed following the advice from the Leicestershire Constabulary Crime Reduction Officer and maintained in accordance with the Information Commissioner's CCTV Code of Practice. This condition imposed to ensure continued use and maintenance.

(b) The Licensee will adopt the Challenge 21 Policy and provide adequate documented training for staff before they are allowed to serve alcohol. This training will be repeated every three months in order to retain focus and records of that training will be provided to Council Licensing Officers and Police on request.

(c) The current and subsequent Designated Premises Supervisor to obtain a recognised qualification for Designated Premises Supervisors. Subsequent Designated Supervisor's to obtain the qualification within three months of becoming the Designated Premises Supervisor of the premises.

(d) No alcohol will be sold unless the container bears a label identifying the store from which it was sold.
