Declaration of interests - members are reminded that following the adoption by Council of the new Code of Conduct, any declaration of interest should be made having regard to the new code. In particular, members must make clear the nature of the interest and whether it is 'personal' or 'prejudicial'.

The Monitoring Officer would like to remind members that when they are considering whether the following items are exempt information under the relevant paragraph under part 1 of Schedule 12A of the Local Government Act 1972 they must have regard to the public interest test. This means that members must consider, for each item, whether the public interest in maintaining the exemption from disclosure outweighs the public interest in making the item available to the public.

6 REVIEW OF THE CONSTITUTION
The Monitoring Officer/Head of Legal and Democratic Services presented her report advising Members of the reasons for the changes to the constitution and the production of a Licensing Code of Conduct/Protocol document. She then referred to page B0003 Item 3.4 to 3.8 which re-examined the issues of Members not sitting on a Licensing Sub-Committee to determin an application in their own area and strongly advised Members against changing the existing policy for the reasons contained in her report.

Whilst Members welcomed the report and agreed the changes recommended in appendix one, some felt that board members should be allowed to sit on a sub-committee to determine applications in their own area. They beleived that their electorate expected them to be involved, especially where there were contentious issues, to look after the interests of the local people. Members were reminded that whilst it is understandable that they would want to represent their area, it could be perceived as bias and threfore could give rise to legal challenge or appeal.
RECOMMENDED THAT:

THE LICENSING CODE OF CONDUCT AND APPENDIX ONE OF THE REPORT BE RECOMMENDED TO COUNCIL ON 5 SEPTEMBER 2006.
