Declaration of interests - members are reminded that following the adoption by Council of the new Code of Conduct, any declaration of interest should be made having regard to the new code. In particular, members must make clear the nature of the interest and whether it is 'personal' or 'prejudicial'.

The Monitoring Officer would like to remind members that when they are considering whether the following items are exempt information under the relevant paragraph under part 1 of Schedule 12A of the Local Government Act 1972 they must have regard to the public interest test. This means that members must consider, for each item, whether the public interest in maintaining the exemption from disclosure outweighs the public interest in making the item available to the public.
1 ELECTION OF CHAIRMAN
It was agreed that Councillor N Smith Chair the Hearing.

Councillor N Smith introduced the parties and explained the procedure to be followed. The Hearing Regulations 2005 stated that the Authority must allow parties an equal period of time in which to present their evidence. It was agreed that the maximum time for each presentation be ten minutes.

 
2 AN APPLICATION FOR A REVIEW OF A PREMISES LICENCE IN RESPECT OF HUNTINGDON STORES, HUNTINGDON LANE, CASTLE DONINGTON
The Licensing Enforcement Officer presented the report and highlighted background information and representations received. In response to a question for clarification, the Licensing Enforcement Officer stated that the store was operating as a general store and an off licence.

Sergeant Moore then presented the application on behalf of Leicestershire Constabulary. He highlighted the events of the three test purchases carried out at the store within a 12 month period and explained the reason a review had been applied for was due to the failing of two of the test purchases. He stated that there had been discussion prior to the meeting between himself and the licence holder's representative, and he agreed with the proposals that had been put forward.

The licence holder's representative explained that Mr Singh had been in the business for 20 years and Mr Thiara had been in the business for eight years, and were very sorry for what had occurred. He stated that as a consequence of this, Mr Singh had now taken a national licensing certificate and would take over from Mr Thiara as the designated premises supervisor. The following proposals were put forward:

a) Mr Singh to replace Mr Thaira as the designated premises supervisor within the next 28 days.

b) The CCTV system to be checked by the Crime Reduction Officer to insure that it was inline with the Crime and Reduction Policy.

c) To implement the Challenge 21 Policy in the premises.

d) Mr Thaira and the one other member of staff to undertake the II Level one qualification when the next local course was available.

At 6.55pm the Sub Committee adjourned to consider its decision and re-convened at 7.27pm.

The Principal Solicitor asked how regular the training sessions were held for the level one qualification. The licence holder's representative confirmed that it was normally held every three months but it varied between different training centres.


RESOLVED:

That the following sanctions and measures offered by the premises licence holder and which were supported by the police be applied:

(a) Mr Singh to replace his son, Mr Thiara, as the Designated Premises Supervisor within 28 days of the hearing.

(b) A condition be added to the licence that Challenge 21 be put in place and implemented.

(c) The Crime Reduction Officer to visit the premises and review the CCTV system that was in place. Mr Thiara and Mr Singh to implement any improvements to the system that were requested by the Crime Reduction Officer.

(d) Mr Thiara and all employees, present and future, to take the B11 Level 1 Responsible Alcohol Retailer Course. No member of staff would be allowed to sell alcohol before there was documented evidence of the course taken. The course to be taken at the earliest opportunity and in any event within three months of the date of the hearing or of staff being employed.
