Neighbourhood plan
Reasons for the decision:
A referendum on 22 November 2018
overwhelmingly supported using the Ashby Neighbourhood Plan to make
planning decisions in Ashby. Before this can be enacted the
District Council is required to consider whether to 'make' the plan
or not.
A report to the Council’s Cabinet on 14 March 17 recommended
(and was accepted that):
IF THE MAJORITY OF THOSE WHO VOTED IN THE REFERENDUM ARE IN FAVOUR
OF THE ASHBY NEIGHBOURHOOD PLAN AND THE DISTRICT COUNCIL DOES NOT
CONSIDER THE MAKNG OF THE NEIGHBOURHOOD PLAN TO BE INCOMPATIBLE
WITH ANY EU OR HUMAN RIGHTS OBLIGATIONS, THE ASHBY NEIGHBOURHOOD
PLAN MUST BE MADE BY THE DISTRICT COUNCIL WITHIN EIGHT WEEKS OF THE
REFERENDUM. THIS WILL TAKE PLACE BY WAY OF DELEGATED
AUTHORITY
The Examiner’s Report assesses issues relating to
compatibility with EU and Human Rights Obligations (as referred to
in the above recommendation) and concludes that the plan meets
these. It is considered that this conclusion is correct.
Alternative options considered:
Whether the plan should be made or not. There
is no valid reason to not make the plan bearing in mind it ahs been
subject to an independent Examination.
