Declaration of interests - members are reminded that following the adoption by Council of the new Code of Conduct, any declaration of interest should be made having regard to the new code. In particular, members must make clear the nature of the interest and whether it is 'personal' or 'prejudicial'.

The Monitoring Officer would like to remind members that when they are considering whether the following items are exempt information under the relevant paragraph under part 1 of Schedule 12A of the Local Government Act 1972 they must have regard to the public interest test. This means that members must consider, for each item, whether the public interest in maintaining the exemption from disclosure outweighs the public interest in making the item available to the public.

RESOLVED THAT:

The minutes of the meeting held on 12 September 2012 be approved.
25 AMENDMENT TO HACKNEY CARRIAGE AND PRIVATE HIRE FIT AND PROPER PERSON POLICY
The Licensing Team Leader presented the report to members, referring to the consultation process which had been undertaken.

In response to a question from a member, the Licensing Enforcement Officer advised that if drivers forgot to notify the Licensing Department of any new convictions, these would come to light during the annual renewal of the licence.
RESOLVED THAT:

a) Licensing Committee agree to the inclusion of the procedure setting out the process when a driver reaches 12 penalty points on their DVLA driving licence detailed at paragraph 3.1

b) Licensing Committee agree the introduction date of 1 December 2012.
26 LICENSING AUTHORITIES WITH MORE POWERS TO DEAL WITH PROBLEMATIC PREMISES - UPDATE PAPER
The Environmental Health Team Manager presented the report to members outlining the process for the introduction of a late night levy or an early morning restriction order. He advised that the next step would be to meet with the Police and seek their views.

A member welcomed the policy and felt that it would act as a deterrent.

In response to questions from members, the Environmental Health Team Manager advised that a late night levy could be introduced concurrently with an early morning restriction order, and indeed should be considered together. He advised that the funding received by the Police was not ring fenced and could be used by them for any purpose. He added that early morning restriction orders would apply to Temporary Event Notice applications.
RESOLVED THAT:

The changes to alcohol licensing law be noted.
27 REVIEW OF CHARITABLE COLLECTIONS POLICY
The Licensing Enforcement Officer presented the report to members, outlining the consultation process which had been undertaken and the responses received.

A member expressed support for the policy.
RESOLVED THAT:

The draft charitable collections policy be approved.
