Declaration of interests - members are reminded that following the adoption by Council of the new Code of Conduct, any declaration of interest should be made having regard to the new code. In particular, members must make clear the nature of the interest and whether it is 'personal' or 'prejudicial'.

The Monitoring Officer would like to remind members that when they are considering whether the following items are exempt information under the relevant paragraph under part 1 of Schedule 12A of the Local Government Act 1972 they must have regard to the public interest test. This means that members must consider, for each item, whether the public interest in maintaining the exemption from disclosure outweighs the public interest in making the item available to the public.

2 APOLOGIES FOR ABSENCE

3 DECLARATION OF INTERESTS
There were no declarations of interest.
 
4 EXCLUSION OF PRESS AND PUBLIC
RESOLVED THAT:

In pursuance of Section 100A (4) of the Local Government Act, 1972, the press and public be excluded from the meeting for the following business on the grounds that it involved the likely disclosure of exempt information as defined in paragraph 7 of Part 1 of Schedule 12A to the Act, and in the circumstances of the matter under consideration, the public interest in maintaining the exemption outweighed the public interest in disclosing the information.
The officers consider that the press and public should be excluded during consideration of the following items in accordance with Section 100(a) of the Local Government Act 1972 as publicity would be likely to result in disclosure of exempt or confidential information.
5 APPLICATION FOR A PRIVATE HIRE DRIVER'S LICENCE
The Licensing Team Leader presented the report and highlighted the options available to members.

There were no questions to the Licensing Team Leader.

The applicant put forward his case. He referred to his early convictions and stated that he was young at the time and was involved in a number of altercations. He explained that all people involved in the incidents were also arrested. He stated that he had stayed out of trouble for a considerable amount of time until the incident at the public house in 2003. The incident involved a long running issue concerning noise from the public house and the applicant had dealt with it in the correct manner through Environmental Health and the police but with no resolution. He explained that at the time he worked early in the morning and had young children, and the noise prevented his family from sleeping.

The applicant stated that in the past he had never initiated any altercations but had only acted in self defence. The applicant circulated an information leaflet regarding spent convictions.

The applicant explained that he had been issued a SIA door supervisor licence which indicated that he was a fit and proper person. The licence details were circulated. He also circulated certificates showing that he had passed a conflict management course as part of his SIA training. He concluded by stating that he was not a bad person, the incidents that had occurred were in his past and he would no longer act like that.

In response to questions from the Legal Advisor, the applicant stated that he held a taxi licence with Nottingham City Council on and off for ten years, and apart from the incident detailed with the report there had been no other warnings or conditions placed on his licence.

In response to a question from a Member, the applicant stated that the conflict management course included training on how to diffuse difficult situations and to keep calm. He felt he was now good at handling conflict.

A Member commented that taxi drivers sometimes have to deal with very difficult situations that could involve drunken passengers that initiate trouble. The applicant stated that he understood this and would now always call the police if it was a situation he could not deal with.

The Licensing Team Leader and the applicant gave a brief closing statement reiterating points raised earlier in the meeting.

At 6.10pm the Sub Committee adjourned to consider its decision. The meeting reconvened at 6.50pm.

RESOLVED THAT:

The application be refused on the following grounds:

That given the stresses involved in dealing with confrontational members of the public may be such that the applicant resorts, as his record shows, to violence to resolve the situation. Therefore the committee were not satisfied that the applicant was a fit and proper person to hold a licence.
