Declaration of interests - members are reminded that following the adoption by Council of the new Code of Conduct, any declaration of interest should be made having regard to the new code. In particular, members must make clear the nature of the interest and whether it is 'personal' or 'prejudicial'.

The Monitoring Officer would like to remind members that when they are considering whether the following items are exempt information under the relevant paragraph under part 1 of Schedule 12A of the Local Government Act 1972 they must have regard to the public interest test. This means that members must consider, for each item, whether the public interest in maintaining the exemption from disclosure outweighs the public interest in making the item available to the public.

9 MINUTES
Minutes of the Meeting held on Wednesday, 18th June, 2008
RESOLVED THAT:

The minutes of the meeting held on 18 June 2008 be signed and approved as a correct record.
10 CONSIDERATION TO BE GIVEN TO ADOPTING 'STRETCH LIMOUSINES' AS ACCEPTABLE VEHICLES TO LICENSE AS A PRIVATE HIRE VEHICLE
The Licensing Team Leader presented the report of the Commercial Services Manager.

Members discussed their concerns with the issues such as the alcohol provided to passengers during the journey, the allowance of left hand side driven vehicles and tinted windows. A Member suggested that other Council's policies are looked at for comparison so that the above issues could be addressed.

The recommendations were moved and seconded with an amendment to the conditions to state that left hand side drive vehicles be permitted.
RESOLVED THAT:

(a) The policy for the licensing of 'Stretch Limousines' be agreed.

(b) The licensing conditions for 'Stretch Limousines' be agreed and approved with an amendment to condition six to permit the use of left hand drive limousines as well as right hand drive.

(c) The implementation of the scheme be delegated to the Commercial Services Manager.

(d) The minor amendment of conditions be delegated to the Licensing Team Leader.

Members asked for a further report to be brought to the Committee to clarify the points raised during discussion of the item.
11 REVIEW OF THE COUNCIL'S FIT AND PROPER TEST FOR HACKNEY CARRIAGE AND PRIVATE HIRE DRIVERS AND IMPLEMENTATION OF DRIVING STANDARDS AGENCY DRIVING ASSESSMENT
The Licensing Team Leader presented the report of the Commercial Service Manager.

In response to questions from Members, the Licensing Team Leader confirmed that the majority of licensed drivers did not hold the DSA certificate and that drivers with an EU drivers licence could be licensed to drive a taxi.
RESOLVED THAT:

(a) All new drivers must submit with their application for a Hackney Carriage or Private Hire Driver's Licence, that appropriate DSA certificate to say that the applicant has taken the DSA Private Hire - Hackney Carriage Assessment.

(b) Any currently licensed driver whose DVLA driving licence attracts six or more penalty point endorsements over a three year period would also be required to take the DSA Private Hire - Hackney Carriage Assessment.

(c) All currently licensed Hackney Carriage and Private Hire Drivers would be required to take the DSA Private Hire - Hackney Carriage Assessment by 1 July 2010.

d) The Council's 'Fit and Proper' policy be agreed and approved in conjunction with (a) - (c) above.

(e) The Commercial Services Manager be authorised to make minor amendments to the policy to reflect changes in other council policies and amendments made by the DVLA to their policies.
