Consideration of Objection Notice in Relation to a Temporary Event Notice pdf icon PDF 152 KB

APPLICANT:Chief Officer of Police

 

To determine an application for a Temporary Event Notice in respect of the above.

 

A representation has been received from the Chief Officer of Police in response to the Temporary Event Notice.  A Notice of Hearing inviting them to attend has been sent to each of them.  If they fail to attend, the hearing can be held in their absence or adjourned.

a)    Report of the Licensing Enforcement Officer

 

At the beginning of the Hearing, the authority shall explain to the parties the procedure it is proposed to follow.  The Hearing shall take the form of a discussion led by the authority and cross-examination shall not be permitted unless it is required to consider the representations.

APPLICANT: Chief Officer of Police

 

The Legal Advisor explained that the applicant had requested that the hearing be adjourned in order that further information could be supplied that would address the concerns raised by the Police.

 

The Legal Advisor confirmed that the Licensing Act (Hearings) Regulations 2005 (Regulation 11) permit the licensing authority to extend the statutory time scales for determining applications when it was in the public interest to do so and that the provision of further information may result in the objection to the TEN being withdrawn. Additionally in the absence of the further information members would be unable to determine the application satisfactorily without risk of challenge.

RESOLVED THAT:

 

The meeting be adjourned under Regulations 11 and 12(1) of the Licensing Act 2003 (Hearings) Regulations 2005.

The meeting was adjourned at 6.40pm, to be reconvened on Tuesday, 8 August 2017 or Wednesday, 9 August 2017 at 6.30pm.
